Another appeal was made to the higher Court of Appeal and on 31st January 2019, the Court of Appeal made its final decision. According to this decision, Dr. Rajan Mahtani was found to be holding 58 percent Portland Cement Zambia shares and was declared at the majority shareholder of the factory. The court also announced that Ventriglias held just 42 percent Portland Cement factory shares and were minority shareholders. Thus, it has been established that the Ventriglias do not have any legal ownership and Dr. Mahtani is the actual owner of the factory. By announcing this decision, the Court of Appeal effectively reversed the earlier decision from the Lusaka High Court.
