Dr. Rajan Lekhraj Mahtani Confirms His Position At The Portland Cement With Significant Court Win

After more than a decade of battle, Dr. Rajan Lekhraj Mahtani was able to win the case for Portland Cement Zambia. The case started when Dr. Rajan Mahtani first registered it at the Lusaka High Court. However, the various limitations and shortcomings of the high court and the Zambian judiciary system in general, Dr. Rajan Mahtani was unable to receive the justice he deserved. The judge at the Lusaka High Court was justice Nkonde and he announced that Ventriglias were only shareholders of the Zambezi Portland Cement.

Not considering this judgment to be authentic, Dr. Rajan Mahtani then approached the Court of Appeal. The Court of Appeal is among the highest judicial systems within Zambia and is approached for cases of national importance, cases which cannot be resolved at lower courts such as high court and cases which are disputed in a significant manner. The judge at the Court of Appeal was justice Mwinde who gave the final announcement on the Portland Cement Zambia on 31^st January 2019. This judgment was given after looking into all evidences and testimonials presented by all parties. According to this judgment, Dr. Rajan Mahtani owned Finsbury Investments is the majority shareholder of the Zambezi Portland Cement with 58 percent shares. On the other hand, Ventriglias owned Ital Terrazzo Limited holds just 42 percent shares and is the minority shareholder without any legal ownership. According to justice Mwinde, this decision aligns with the original shareholders agreement which was established in the year 2007. Based on this decision, it is proven that Dr. Rajan Mahtani is the legal owner of the Zambezi Portland Cement factory.

Furthermore, the judge from the Court of Appeal also said that that the judge below him was wrong in declaring Ventriglias as only shareholders as this decision was without any evidence. As of now, Dr. Rajan Mahtani has been concluded as the majority shareholder and legal owner of the Zambezi Portland Cement factory.
