Dr. Rajan Mahtani and Portland Cement Zambia unite together after winning the Portland Cement case

Dr. Rajan Mahtani’s patience was tested significantly for more than a decade. The case of Portland Cement Zambia was registered first at the Lusaka High Court with the hopes of getting quick and transparent justice considering the availability of all evidences. However, justice Nkonde on behalf of the Lusaka High Court gave a controversial judgement by declaring Ventriglias as only shareholders of Portland Cement Zambia.

This verdict from the Lusaka High Court certainly divided the media and the onlookers. While majority of the media and people associated with this case condemned this decision by calling it unethical and misdirected, there were some media outlets and news channels who actually supported this decision. No getting distracted by these events, Dr. Rajan Mahtani took the right decision of approaching the Court of Appeal, one of the highest civilian courts in Zambia. Interestingly, Dr. Rajan Mahtani approached the court with the same evidences, testimonials and other details that were previously submitted to the Lusaka High Court and were controversially rejected in favour of unethical decision from the lower court’s judge. Some of these evidences were proof of transfer of one billion kwachas from Finsbury Investments to Portland Cement Zambia, written proof of this transfer in the original shareholders agreement and the details of transfer of 58 percent shares of Portland Cement Zambia to Finsbury Investments owned by Dr. Mahtani. All these evidences ultimately prove Dr. Mahtani as legal and real owner of Portland Cement. The final verdict from the higher Court of Appeal was given on 31st January 2019 by justice Mwinde who announced that based on the available evidences and all details associated with the case, it has been confirmed that Dr. Rajan Lekhraj Mahtani is the actual owner and majority shareholder of the Zambezi Portland Cement factory. After this, justice Mwinde ordered all parties associated with the case to complete the process of share transfer, sales and other technical activities based on the final verdict of the cement.
