Supreme Court Judge Mumba Malila comes in defence of Dr. Rajan Mahtani

Given the sorry state of the Zambian law and governance, it is no surprise that Dr. Rajan Mahtani has been falsely accused of. As a result, it was a surprise for a Supreme Court Judge to come forward and release a testimony in favour of Dr. Mahtani. In his testimony, the Supreme Court Judge Mumba Malila clearly stated that the prosecution of Dr. Rajan Mahtani in the 2012 case was influenced by political motivations. It was a concern during that time also and as a result, suggestions were made to make the prosecution null and void. Even after raising concerns that the prosecution was falsely done and was against the interests of the public policy, nothing was done to correct the false charges.

Dr. Rajan Mahtani has made a name for himself within the Zambian business society for his transparent and ethical business practices. The current revelation is a clear indication that even though Dr. Mahtani knew that he was being falsely prosecuted, he did not engage in unethical or illegal activities to make the case go away. Instead, he and his lawyers kept on fighting the case and the judgment and after years of patience, some results can be seen. The testimony from the Supreme Court Judge is a huge boost for Dr. Rajan Mahtani and his businesses. It will also help him in his current pursuit of one of his companies which was wrongfully taken away from him and for which he has been fighting a case for more than ten years.

The testimony from the SC Judge also revealed the dark side of the Zambian governance. It took the judge almost seven years to come clean and revisit the false accusations. It is clear that the greed of few powerful people and associations are resulting in sustained corruption and unethical business practices in Zambia, harming and creating difficulties and roadblocks for anyone trying to establish honest and transparent business practices within the nation.
